Cluenomy Terms of Use

These terms are an agreement between you and Vickneswaran A/L Eliathamby, trading as Cluenomy, 23-05, Residensi Berlian Setapak, No. 8 Jalan Semarak Api 4, Off Jalan Gombak, 53000 Kuala Lumpur, Malaysia ("we", "us"), about using the Cluenomy app. Please read them with our Privacy Policy.

1. Who can use Cluenomy

Cluenomy is for everyone. If you are under 18, or under the age of majority where you live, a parent or guardian must agree to these terms for you and is responsible for any purchases.

2. What Cluenomy is

Cluenomy is a daily detective game for practising everyday judgement: one free case a day, plus optional extras with Case Pass.

• It's for practice and fun. It is not professional, medical, legal or financial advice.
• We don't promise it will raise your intelligence or test scores.

3. The free club and Case Pass

• Free for everyone, always: one new case each day, your case files and your skills.

• Case Pass (optional, paid) adds:

  • 3 bonus cases every week
  • the full case archive
  • practice picked for your skills
  • bonus accessories to earn

  We may change what Case Pass includes, but we won't take away something you've already paid for during that billing period.

• Case packs (optional, one-time purchases): a themed set of 12 cases and a finale, bought once with no subscription. A pack you buy is yours to keep and comes back with Restore purchases on a new device signed in to the same app store account. The first case of every pack is free to try. Case Pass includes the packs marked "Included" for as long as it's on; if Case Pass ends, those packs close again, but packs you bought stay yours. Some packs may not be part of Case Pass; the pack's page says so before you buy.

• Prices are shown in the App Store or Google Play before you buy, in your local currency and including tax where required.

4. Subscriptions, renewals and cancelling

• Case Pass renews automatically (monthly or yearly, whichever you chose) until you cancel. Your app store account is charged at the start of each period.
• Cancel at least 24 hours before renewal to avoid the next charge. Do it in your App Store or Google Play subscription settings. You keep Case Pass until the end of the period you've paid for.
• Yearly plans: we'll remind you about a week before your yearly plan renews.
• Refunds are handled by Apple or Google under their refund policies. Contact them first, or us at [email protected] if you need help.
• Your right to cancel (EU, UK and similar): by starting Case Pass straight away, you agree it begins at once, and you understand that your right to withdraw within 14 days may end once the service has started. This doesn't affect your other consumer rights.
• Price changes: if the price of your plan changes, the app store will tell you in advance and, where the law requires, ask you to agree.

5. Playing fair

Please don't:

• copy, sell or share Cluenomy's cases, characters or artwork outside the app, except sharing your own case card using the in-app share button;
• try to break, hack, reverse-engineer or get around the app's security or purchases, except where the law allows it;
• use Cluenomy for anything unlawful.

6. Who owns what

Cluenomy, its cases, characters (including Curious, Hunchwick, Dot, Ponderby, Zip and Rook), artwork, text and software belong to us or our licensors. Using the app gives you a personal, non-exclusive, non-transferable right to use it on devices you own or control, under these terms and the app store's rules.

7. Changes and availability

• The app changes over time. We may update it, add or remove cases, or change features. We'll give notice in the app of important changes to these terms.
• Accepting new terms: if you keep using the app after a change takes effect, you accept the new terms. If you don't agree, you can stop using it and cancel Case Pass.
• Where it's available: Cluenomy may not be available in every country.

8. If things go wrong

We work hard to keep Cluenomy running and accurate, but it is provided "as is" as far as the law allows.

Nothing in these terms limits rights you have under your local consumer law that can't be limited. That includes rights about faulty digital content, and liability for death or personal injury caused by negligence, or for fraud.

Otherwise, as far as the law allows, our total liability to you is limited to the amount you paid us in the 12 months before the claim.

9. Ending these terms

You can stop using Cluenomy any time by deleting the app (and cancelling Case Pass in your store settings). We may suspend access if you seriously break these terms, as far as the law allows.

10. Law and disputes

These terms are governed by the laws of Malaysia. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.

11. Apple App Store terms

If you got Cluenomy from Apple's App Store:

• The agreement: these terms are between you and us, not Apple. Apple isn't responsible for the app or its content.
• Your licence: you may use the app on Apple devices you own or control, as allowed by the App Store's Usage Rules.
• Support and maintenance: we are responsible for these, not Apple.
• If the app doesn't meet a warranty:
  • You can tell Apple, and Apple will refund the purchase price, if any.
  • As far as the law allows, Apple has no other warranty obligation.
• Claims: we, not Apple, are responsible for handling any claims about the app. That includes product liability, legal compliance, consumer protection and privacy claims.
• Intellectual property: if someone claims the app infringes their intellectual property, we, not Apple, will handle it.
• Legal status: you confirm you're not in a country under a US government embargo, and not on a US government list of prohibited or restricted parties.
• Apple's rights: Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
